1. Bedingte Deckungsklauseln (Warranties & Conditions Precedent)
In englischen Policen unterscheidet man zwischen einfachen Bedingungen (conditions) und strikten Garantieklauseln (warranties). Wird eine condition precedent (Voraussetzung für den Leistungsfall) nicht erfüllt – zum Beispiel die Einhaltung der Meldefrist –, leistet der Versicherer für diesen konkreten Schadenfall nicht.
2. "Provided that" und "Subject to" als Alternativen zu "If"
In formellen Verträgen wird das Wort if häufig durch juristisch präzisere Wendungen ersetzt:
- Provided that / On condition that: "Vorausgesetzt, dass..." (z. B. Provided that the premium is paid, coverage attaches...)
- Subject to: "Unter dem Vorbehalt, dass..." (z. B. Subject to satisfactory inspection, the binder is active.)
