Versicherungs-Englisch: Leistungsablehnung & Vertragsrecht
Claim Denials and Contractual Frameworks
In the insurance industry, not every claim can be accepted. When an insurer decides not to pay a claim, this is officially called a claim denial or rejection. These legal decisions are strictly based on insurance contract law and the detailed conditions listed in the policy wording.
This module introduces the key terms and legal expressions used when corporate claims are refused, contract conditions are breached, or formal legal disputes arise.
Niveau: B1
Practical Legal Examples
The insurer officially denied the commercial property claim yesterday.
Hiding a previous loss configuration constitutes a clear case of non-disclosure.
The contract became void because the policyholder provided completely fraudulent details.
Essential Terminology
| English Term | German Translation | Simple Context Definition |
|---|---|---|
| claim denial / rejection | Leistungsablehnung | The official decision by an insurer not to pay out a claim. |
| policy exclusion | Leistungsausschluss | A specific situation, risk or peril that is not covered by the contract. |
| breach of contract | Vertragsverletzung | A failure to fulfill a legal obligation agreed upon inside the policy. |
| void contract | Nichtiger Vertrag | A contract that is cancelled and treated as invalid from the beginning. |
| non-disclosure | Anzeigepflichtverletzung | The illegal act of hiding important facts from the underwriting team. |
| liability dispute | Haftungsstreit | A disagreement regarding who is legally responsible for a loss. |
| arbitration | Schiedsverfahren | Settling a legal argument using an independent specialist instead of a court. |
Legal Tip: Non-Disclosure vs. Misrepresentation
Both actions can make an insurance policy void, but the intent is slightly different:
Non-disclosure means remaining silent and actively hiding a material fact (e.g., forgetting to mention a past fire claim).
Misrepresentation means giving an actively false statement on the proposal form (e.g., stating a warehouse has an active sprinkler system when it does not).
Business Dialogue: Explaining a Claim Rejection
Claims Handler: Good morning, Mr. Miller. We have finished our legal review of your warehouse damage claim.
(Guten Morgen, Herr Miller.
Policyholder: Good morning. Are you going to release the repair payment this week?
(Guten Morgen. Werden Sie die Reparaturzahlung diese Woche freigeben?)
Claims Handler: Unfortunately, we must deny this claim because the root cause falls under a specific exclusion.
Policyholder: An exclusion? This sounds like an absolute breach of contract on your side! We paid all our premiums.
(Ein Ausschluss? Das klingt nach einem absoluten Vertragsbruch Ihrerseits! Wir haben alle unsere Prämien bezahlt.)
Claims Handler: I understand your situation. However, the expert verified that the leak was caused by wearing out and lack of maintenance. Wear and tear is excluded in paragraph four.
Policyholder: We dispute this engineering report. What are our options now?
(Wir fechten diesen technischen Bericht an. Welche Möglichkeiten haben wir jetzt?)
Claims Handler: If your broker disputes the technical analysis, your company has the legal right to trigger the formal arbitration clause.
Grammar Focus: Modal Verbs in Legal Decisions
In contract discussions, **must** is used for absolute legal requirements, while **may** or **could** are used for possibilities under specific contract conditions.
The claimant must provide original invoices to verify the actual value.
A serious misrepresentation may render the entire insurance policy void.
